The purpose of this article is to discuss the terms of representation and the theory of authorization in Hobbes, highlighting, in turn, the adversities and inconsistencies in the way the fictitious attribution interferes with the constitution of authority in Hobbes. In this sense, it becomes necessary to discuss the way in which Hobbes determines the function of the representative in the absence of his identification as author, that is, without any condition to attribute authority to his actors. This is, therefore, (...) a contradiction in terms of the rationality imposed by the model of representation proposed by Hobbes, in which the imputation of responsibility, in the case of the fictitious person, is absent of responsibility for his acts and, thus, making it impossible to assume responsibility for the acts of another. To this end, the aspects of the fictitious person and his relationship with the precepts of unauthorized authorization are highlighted in order to define the terms of the fictitious attribution and its implications in the legal theory of authorization in Hobbes. O objetivo deste artigo é problematizar a questão da segurança em Hobbes. Para tanto, discute-se a função do medo como um elemento fundamental para a obtenção da vida agradável, demonstrando o vínculo entre o medo e a razão instrumental como requisito fundamental na obtenção dos meios adequados para a instauração da segurança, a garantia das coisas que são necessárias para o estabelecimento da vida agradável. A hipótese que se pretende evidenciar é aquela segundo a qual a obtenção da segurança de (...) uma vida agradável depende necessariamente do cálculo instrumental das causas e consequências motivado pelo medo. Utilizando-se, portanto, do argumento do medo da morte violenta, relaciona-se a necessidade dos requisitos necessários para uma vida agradável à liberdade, compatível com a segurança e as condições de bem-estar do povo. Sendo assim, a segurança com a qual Hobbes preocupa-se é a segurança em vista de uma vida agradável. (shrink)

O propósito fundamental do presente artigo consiste em examinar os termos da liberdade em Hobbes, utilizando-se do sentido liberal de liberdade, por vezes atribuído ao modo como o filósofo concebe a sua posição sobre a liberdade, mediante as discussões de Quentin Skinner acerca da concepção “neorromana” de liberdade ou a liberdade republicana. Com base nesse pressuposto, pretende evidenciar como a concepção moderna de liberdade é inteiramente dependente da construção hobbesiana da “liberdade negativa”, influenciada diretamente por um debate político ocorrido na (...) Inglaterra nos meados do século XVII. Com base nesses elementos, o cerne das discussões que serão empreendidas no presente artigo diz respeito à crítica hobbesiana à liberdade republicana como pressuposto para demonstrar o desenvolvimento da concepção moderna de liberdade. Uma vez examinada essa relação, será possível, portanto, evidenciar os aspectos marcantes do liberalismo presentes na argumentação política de Hobbes. (shrink)

A relação entre os termos do contratualismo e da justiça é uma questão relevante a ser discutida no âmbito do projeto filosófico e político de Hobbes. Trata-se, portanto, de uma relação que subjaz a lógica interna do seu projeto contratualista, enquanto uma relação entre promessas de cumprimento e uma ação contrária capaz de desfazer o princípio de qualquer acordo efetivamente expresso. Nesse sentido, há, portanto, duas ações no núcleo do acordo consensual proposto por Hobbes, uma ação injusta e outra justa, (...) ou seja, uma de “quebra” do acordo, outra do cumprimento da promessa. Essas ações são os elementos conceituais mais relevantes para refletir o sentido do ato justo e injusto no âmbito do contratualismo hobbesiano. O justo compreende o cumprimento do acordo e, por outro, o seu descumprimento é uma ação injusta. Não obstante, deve-se indagar: o que determina o cumprimento e o descumprimento do acordo? Em que sentido uma “vida virtuosa” depende de cumprir promessas, acordos e pactos? O propósito desse artigo consiste em evidenciar o cerne da temática da justiça em Hobbes considerando, sobretudo, a sua intrínseca relação com o seu argumento contratualista. Nessa relação, analisam-se o caráter dúbio das atribuições das palavras justo e injusto, assim como as de justiça e da injustiça. Diante disso, o direcionamento do debate proposto será de examinar a natureza da concepção de justiça, utilizando-se do modo como Hobbes concebe as determinações de uma verdadeira ação justa, ao passo que mediante tais esclarecimento seja possível conceber um homem justo e, consequentemente, um homem virtuoso e a pratica de uma vida virtuosa. Background: The new human coronavirus that leads to COVID-19 has spread rapidly around the world and has a high degree of lethality. In more severe cases, patients remain hospitalized for several days under treatment of the health team. Thus, it is important to develop and use technologies with the aim to strengthen conventional therapy by encouraging movement, physical activity, and improving cardiorespiratory fitness for patients. In this sense, therapies for exposure to virtual reality are promising and have been shown to (...) be an adequate and equivalent alternative to conventional exercise programs.Aim: This is a study protocol with the aim of comparing the conventional physical therapy intervention with the use of a non-immersive VR software during COVID-19 hospitalization.Methods: Fifty patients hospitalized with confirmed diagnosis of COVID-19 will be divided in two groups under physiotherapy treatment using conventional or VR intervention: Group A: participants with COVID-19 will start the first day of the protocol with VR tasks in the morning and then in the second period, in the afternoon, will perform the conventional exercises and Group B: participants with COVID-19 will start the first day with conventional exercises in the morning and in the second period, in the afternoon, will perform activity with VR. All participants will be evaluated with different motor and physiologic scales before and after the treatment to measure improvements.Conclusion: Considering the importance of benefits from physical activity during hospitalization, VR software shows promise as a potential mechanism for improving physical activity. Esse trabalho tem como objetivo analisar a ocorrência de Teresas na literatura brasileira, como heroínas divididas entre o sacro e o profano. Propomos o estudo do romance Tereza Batista: (...) cansada de guerra, de Jorge Amado, a partir da intertextualidade com a tradição literária baiana, de Gregório de Matos e Castro Alves, e em contraponto ao pensamento religioso da obra lírica de Santa Teresa de Ávila, em diálogo com a escultura extática da santa, criada por Gian Lorenzo Bernini.Palavras-chaves: Santa Teresa de Ávila. Conservatism about perceptual justification tells us that we cannot have perceptual justification to believe p unless we also have justification to believe that perceptual experiences are reliable. There are many ways to maintain this thesis, ways that have not been sufficiently appreciated. Most of these ways lead to at least one of two problems. The first is an over-intellectualization problem, whereas the second problem concerns the satisfaction of the epistemic basing requirement on justified belief. I argue that there is at (...) least one Conservative view that survives both difficulties, a view which has the further ability to undercut a crucial consideration that has supported Dogmatist views about perceptual justification. The final section explores a tension between Conservatism and the prospects of having a completely general account of propositional justification. Ironically, the problem is that Conservatives seem committed to making the acquisition of propositional justification too easy. My partial defense of Conservatism concludes by suggesting possible solutions to this problem. (shrink)

A série se passa em uma sociedade distópica, regida à base da teonomia totalitária e fundamentalista cristã. As mulheres dessa sociedade perderam suas vozes, são desumanizadas, devido ao seu gênero, e tornadas objetos férteis nas mãos de seus comendadores; a narrativa e o desenvolvimento das personagens fazem alusão ao empoderamento feminino e suas lutas (...) pelos direitos civis que vêm acontecendo desde o fim século XIX. The special composition question asks, roughly, under what conditions composition occurs. The common sense view is that composition only occurs among some things and that all and only ‘ordinary objects’ exist. Peter van Inwagen has marshaled a devastating argument against this view. The common sense view appears to commit one to giving what van Inwagen calls a ‘series-style answer’ to the special composition question, but van Inwagen argues that series-style answers are impossible because they are inconsistent with the transitivity of (...) parthood. An argument is epistemically self-defeating when either the truth of an argument’s conclusion or belief in an argument’s conclusion defeats one’s justification to believe at least one of that argument’s premises. Some extant defenses of the evidentiary value of intuition have invoked considerations of epistemic self-defeat in their defense. I argue that there is one kind of argument against intuition, an unreliability argument, which, even if epistemically self-defeating, can still imply that we are not justified in thinking intuition has evidentiary (...) value. In this paper I study the variants of the notion of completeness Husserl pre-sented in “Ideen I” and two lectures he gave in Göttingen in 1901. Introduced primarily in connection with the problem of imaginary numbers, this notion found eventually a place in the answer Husserl provided for the philosophically more im-portant problem of the logico-epistemological foundation of formal knowledge in sci-ence. I also try to explain why Husserl said that there was an evident correlation between his and Hilbert’s notion (...) of completeness introduced in connection with the axiomatisation of geometry and the theory of real numbers when, as many commen-tators have already observed, these two notions are independent. I show in this paper that if a system of axioms is complete in Husserl’s sense, then its formal domain, the manifold of formal objects it determines, does not admit any extension. This is precisely the idea behind Hilbert’s notion of completeness in question. Therefore, the correlation Husserl noted indeed exists. But, in order to see it, we must consider the formal domain determined by a formal theory, not its models. (shrink)

Reification, fetishism, alienation, mastery, and control – these are some of the key concepts of modernity that have been battered and beaten by postmoderns and nonmoderns alike, with Bruno Latour, a nonmodern, discarding them most recently. Critical of this approach, which creates a rift between moderns and nonmoderns, the author engages in dialogue with modern thinkers – particularly Peter Berger, Thomas Luckmann and Stanley Pullberg – with a view to recycling and redefining the concept of reification from a nonmodern perspective. (...) Marxian scholars associate reification with an attitude of detachment and passivity. Drawing on two years of ethnographic fieldwork in a Luvale-speaking region of northwest Zambia, Africa, the author seeks to convert the negative and asymmetrical Marxian reading of reification, which places subjects above objects, to a positive symmetry. Marx explained the capitalist economy through the lens of religion. Reversing the direction of symmetrical comparison, the author considers the northwestern Zambian universe of ancestors and their different mahamba manifestations in the form of spiritual beings, diseased bodies and material objects through the lens of Marxian concepts, mainly reification and fetishism. Three aspects of reification understood as a human universal come to light: first, reification and animation entail each other both in the realms of materiality (human bodies and material objects) and immateriality (concepts and spirits), being best perceived as a form of fetishism. Reifacts are fetishes and fetishes are reifacts. Second, because fetishes are animated and do things, reification is a form of engagement with the world, a means to action and a tool for transformation. Third and last, and without contradiction, reification entails engagement and detachment, action and withdrawal, control and surrender. There is much to gain from recycling the old concept of reification. In a non-partisan symmetrical perspective, the redefinition of reification as fetishism yields a new, positive understanding of the place of material and immaterial things in social life and the ways in which we humans apprehend the world and implicate those things in our projects and struggles. Studies investigating the relationship between artificial intelligence and science tend to adopt a partial view. There is no broad and holistic view that synthesizes the channels through which this interaction occurs. Our goal is to systematically map the influence of the latest AI techniques on science. We draw on the work of Nathan Rosenberg to develop a taxonomy of the effects of technology on science. The proposed framework comprises four categories of technology effects on science: intellectual, economic, experimental and instrumental. (...) The application of the framework in the relationship between ML/DL and science allowed the identification of multiple triggers activated by the new techniques in the scientific field. Visualizing these different channels of influence allows us to identify two pressing, emerging issues. The first is the concentration of experimental effects in a few companies, which indicates a reinforcement effect between more data on the phenomenon and more capacity to commercialize the technique. The second is the diffusion of new techniques lacking in explanation throughout the fabric of science. The value of this article is twofold. First, it provides a simple framework to assess the relations between technology and science. Second, it provides this broad and holistic view of the influence of new AI techniques on science. More specifically, the article details the channels through which this relationship occurs, the nature of these channels and the loci in which the potential effects on science unfolds. (shrink)

Although it is now commonplace to take emotions to be the sort of phenomena for which there are reasons, the question of how to cash out the reason-responsiveness of emotions remains to a large extent unanswered. I highlight two main ways of thinking about reason-responsiveness, one that takes agential capacities to engage in norm-guided deliberation to underlie reason-responsiveness, and another which instead takes there to be a basic reason-relation between facts and attitudes. I argue that the latter approach should be (...) preferred. Not only does a reasons-basic approach promise to fare better in accounting for cases that its opponent struggles to accommodate, but it promises also to uncover a sui generis relation between emotions and their reasons which is at best obscured and at worst denied by its opponent. Trata-se de uma resenha das obras Sobrinho de Rameau de Denis Diderot, Sobre a Verdade e Mentira no sentido Extra-Moral de Friedrich Nietzsche e A construção das ciências: introdução à filosofia e á ética das ciências de Gerárd Fourez. Os textos foram lidos com base nas seguintes questões: Quais são as bases de sustentação do conhecimento?; O que é a verdade e se é possível alcançá-la de forma objetiva; O que é a ciência e o que ela representa na busca (...) pela verdade e o conhecimento? e Quais as possibilidades da linguagem na busca pelo conhecimento? Concluiu-se que o que Diderot caracteriza como idiotismo aparenta-se com os valores morais seguidos pelo instinto de rebanho nos indivíduos de Nietzsche. Para Fourez observar é sempre representar e na representação nunca se obtém do objeto sua verdadeira essência. Desconstruir conceitos, apreender o aspecto fluido e mutável das coisas e dos valores, seria essa a linha mestra dos textos tratados neste trabalho. (shrink)

O questionamento que norteia este estudo pode ser assim delineado: Como dialogam Escola dos Annales e a Análise de Conteúdo em pesquisas de caráter histórico? A partir dessa questão, a estrutura narrativa traz aproximações epistemológicas entre ambas as escolhas metodológicas e tece problematizações relativas às desconfianças e resistências no entorno das mesmas. Foram consultados estudiosos que tratam da Interdisciplinaridade, Pesquisa em Educação, Análise de Conteúdo, Método e Teorias Históricas. A discussão compreendeu: O lugar da pesquisa histórica/historiográfica; Escola dos Annales e (...) Análise de Conteúdo nas pesquisas qualitativas e a busca do implícito nas fontes. Por fim, o estudo sublinhou possibilidades de diálogo entre Escola dos Annales e Análise de Conteúdo. (shrink)

The burdens of mental illnesses and substance use disorders do not lie merely with the individuals who suffer from these conditions but affect, and are affected by, their families, communities, cities and countries. The ethical and political challenges that arise in the treatment of mental illnesses and substance abuse disorders are, therefore, challenges that affect both individuals and communities.

Neste artigo, pretendo apreciar a recepção de Agostinho em “As confissões da carne”, volume 4 da História da sexualidade, de Michel Foucault, especialmente no penúltimo capítulo da obra “O bem e os bens do casamento”, com um propósito geral duplo: entender melhor, de um lado, por que a obra agostiniana é expediente privilegiado para Foucault apresentar criticamente a subjetivação e a objetivação de uma moral sexual cristã, bem como problematizar, por outro lado, em que medida a leitura foucaultiana de Agostinho (...) projeta nele e em geral nos pères de l’église uma agenda psicanalítica consideravelmente estranha a eles. La presente contribución tiene por objeto develar y dar respuesta a ciertas dificultades propias de la definición de la justicia basada en el concepto de amor profesada por el joven Leibniz. En un esfuerzo por capitalizar una definición de la justicia sobre la cual sea posible materializar su proyecto de una jurisprudencia universal, Leibniz encuentra en el concepto de amor el elemen­to central de la justicia. Sin embargo, frente a esta indagación de carácter puramente especulativo, aparece la experiencia, que revela (...) la existencia de injusticias en el mundo. Admitiendo la existencia del mal y de injusticias, Dios todopoderoso no parece –como ha de ser no obstante el caso– amar a todos los hombres. Si Leibniz no enuncia explícitamente esta conse­cuencia que se deduce del contraste entre su definición de la justicia y la experiencia, ella es, empero, el acápite con que él pretende resolver el problema en su primera teodicea: la Con­fessio Philosophi. Antes que la predestinación, es la herética consecuencia según la cual Dios no ama a todos los hombres lo que motiva la reflexión de Leibniz en la Confessio, y la que guía su solución a dicho problema. A proposta deste trabalho é mostrar alguns aspectos da contribuição da metáfora para a construção de novas subjetividades mediante a modificação das redes de crenças e desejos humanos na perspectiva do filósofo Richard Rorty. O aporte teórico baseia-se na produção de autores como: Rorty, Davidson e Calder, dentre outros. Rorty sustenta que é a partir da modificação das práticas linguísticas e de outras práticas sociais que novas subjetividades, isto é, novos tipos de seres humanos são produzidos. Nesse processo, somente uma (...) redescrição pode configurar um resposta à outra redescrição, isto porque não existe nenhuma instância a-histórica, universal e absoluta que sirva de ponto neutro para julgar todas as culturas, que no seu entender são vocabulários corporificados. Finalmente, procuramos demonstrar que para Rorty, as compreensões de Freud e Davidson sobre a metáfora permitem novas possibilidades para o uso da linguagem, no sentido de criar novos vocabulários ou práticas linguísticas que contribuem na construção de subjetividades alternativas, provisórias e redescritas. Após consolidar o fundamento objetivo da lei moral na razão pura prática, Immanuel Kant investiga o fundamento subjetivo e introduz o sentimento. De produto da razão, a lei moral será examinada como efeito sobre o ânimo, numa dialética de desprazer e prazer, da qual surge o sentimento moral. O presente artigo visa problematizar este aspecto da ética do filósofo à luz da Crítica da faculdade do juízo e dos conceitos princípio do prazer e princípio da realidade de Sigmund Freud. Ao (...) colocar em questão a relação entre sentimento de prazer e moral nos dois pensadores, indaga se no filósofo não estaria em questão a descoberta da realidade interna da heteronomia. (shrink)

This paper engages with debates about the increasing use of paid domestic labour in Europe and the USA, contributing with a reflection about the case of Brazil. Relations of gender, class and race are considered in the deployment of maids for housework, the patterns of consumption of household technologies and the moral reasoning of daily living with hierarchical divisions within the home. The paper considers some parallels between the Brazilian context and that of more developed countries and also the specificity (...) of Brazil. Based on participant observation, secondary data and an ethnographic study, rich empirical data is weaved through to discuss material and moral dimensions of domestic labour and care. How does the availability of cheap domestic labour configure relations of inequality? How are social differences in the home lived with and justified? The exploration of the Brazilian case illuminates some of the problems, contradictions and possible consequences of wealthier households benefitting from the displacement of poor women that is currently happening through international migration. The paper argues that in Brazil the deflecting of tensions in gender divisions of labour in households onto a subordinate person has affected relations of equality between women and men and also the patterns of technological innovation to facilitate housework. These are outcomes to be guarded against in Europe and the United States in face of the current trends in ‘global woman’ relations. (shrink)

The concept of dignity has occasioned a robust conversation in recent healthcare scholarship. When viewed as a whole, research on dignity in healthcare has engaged each of the four bioethical principles popularized by Beauchamp and Childress, but has paid the least attention to beneficence. In this paper, we look at dignity and beneficence. We focus on the dignity promotion component of a model of dignity derived from a grounded theory study. After describing the study and presenting a précis of the (...) resulting model, we review the principle of beneficence and look at the ways in which the notion of dignity promotion can be used to complement our understanding of this principle. Specifically, we explore what we can learn from dignity promotion about the relational nature of beneficence in healthcare and how dignity promotion can be marshaled to help address the epistemological quandary of soft paternalism. John Stuart Mill is central to parallel debates in mainstream contemporary political epistemology and philosophy of federalism concerning the epistemic dimension(s) of legitimate authority. Many scholars invoke Mill to support epistemic arguments for democratic decision-making and decentralized federalism as a means of conferring democratic legitimacy. This article argues that Millian considerations instead provide reason to reject common epistemic arguments for decentralized federalism. Combining Mill's own insights about the epistemic costs of decentralization and recent work in philosophy, politics, and economics undermines (...) purportedly Millian arguments for federalism focused on political experimentation, diversity and participation. Contrary to many interpretations, Millian considerations weaken, rather than strengthen, arguments for federalism. Any valid justification for federalism must instead rest on non-epistemic considerations. This conclusion is notable regardless of how one interprets Mill. But it also supports Mill's stated preference for local decisions subject to central oversight. (shrink)

ABSTRACT Around 390 BC, Isocrates wrote a text dedicated to the mythical Helen, Encomium of Helen. According to the rhetorician, his objective was to praise that character, who was recognized in two of Homer’s main works, the Iliad and the Odyssey. Although the isocratic text has already been thoroughly studied, we believe that Discourse Analysis will provide a more in-depth view of the text and its argumentative strategies. Thus, our objective is to analyze how the argumentative construction of the Encomium (...) of Helen took place. From the analysis, it was possible to notice that discourses have different layers, that Isocrates uses Helen’s story as a foundation for his argumentation and that the rhetorician reproduces imaginaries of femininity and masculinity, although this was not an explicit objective. ABSTRACT This article aims to analyze the process of mutual understanding from the perspective of Discursive Neurolinguistics. As a methodology, a case study was carried out on a child with a linguistic profile of verbal restriction, which concerns the dimension of utterances involving words and their morphology. Data interpretation was based on the Bakhtinian perspective, which addresses ‘understanding’ as an active-responsive process and meaning as emerging from the relationship between utterances. The results showed that the interlocutors’ common ground allowed the (...) joint construction of meaning even in the face of verbal restrictions, and aspects such as nonverbal elements and the recognition of the child’s active-responsive role also favored mutual understanding. As a conclusion, the attention to different multimodal resources as legitimate modes of expression allows children with verbal restrictions to fulfill the role of “speakers” regardless of their modes of expression. Husserl left many unpublished drafts explaining (or trying to) his views on spatial representation and geometry, such as, particularly, those collected in the second part of Studien zur Arithmetik und Geometrie (Hua XXI), but no completely articulate work on the subject. In this paper, I put forward an interpretation of what those views might have been. Husserl, I claim, distinguished among different conceptions of space, the space of perception (constituted from sensorial data by intentionally motivated psychic functions), that of physical (...) geometry (or idealized perceptual space), the space of the mathematical science of physical nature (in which science, not only raw perception has a word) and the abstract spaces of mathematics (free creations of the mathematical mind), each of them with its peculiar geometrical structure. Perceptual space is proto-Euclidean and the space of physical geometry Euclidean, but mathematical physics, Husserl allowed, may find it convenient to represent physical space with a non-Euclidean structure. Mathematical spaces, on their turn, can be endowed, he thinks, with any geometry mathematicians may find interesting. Many other related questions are addressed here, in particular those concerning the a priori or a posteriori character of the many geometric features of perceptual space (bearing in mind that there are at least two different notions of a priori in Husserl, which we may call the conceptual and the transcendental a priori). I conclude with an overview of Weyl’s ideas on the matter, since his philosophical conceptions are often traceable back to his former master, Husserl. (shrink)

The philosophical relation between Husserl and Heidegger is a milestone in the 20th century philosophy. On the one hand, Husserl preserved the notions of subject and consciousness, avoiding naïve misconceptions of these notions and clearing new paths for philosophical investigation. On the other hand, Heidegger, departing from a criticai dialogue with Husserl’s phenomenology, challenged key presuppositions of modern philosophy by investigating the social and pragmatic dimension ofkllowledge and intentionality.

One of the main problems in computer science is to ensure that programs are implemented in such a way that they satisfy a given specification. There are many studies about methods to prove correctness of programs. This work presents a method, belonging to the constructive synthesis or proofs-as-programs paradigm, that comes from the Curry-Howard isomorphism and extracts the computational contents of intuitionist proofs. The synthesis process proposed produces a program in an imperative language from a proof in many-sorted intuitionist logic, (...) where the axioms define the abstract data types, using Natural Deduction as deductive system. It is proved the correctness, as well as the completeness of the method regarding the Heyting arithmetic with ω-rule . A discussion about the use of the finitary induction instead of computational ω-rule concludes the work. (shrink)

Research on how to understand legally recognized socio-economic rights produced many insights into the nature of rights. Legally recognized rights to health and, by extension, health care could contribute to health justice. Yet a tension remains between widespread international and transnational constitutional recognition of rights to health and health care and compelling normative conditions for rights recognition from both philosophers seeking to identify the scope and structure of the rights and policy scholars seeking to understand how to practically realize such (...) rights. This work identifies an overlooked source of these difficulties: the right to health care and other health rights are necessarily ‘complex’, consisting of multiple related, but irreducible, morally valuable components. ‘Complex rights’ do not fit the traditional structure of human rights, so legal recognition of same can appear confused from a philosophical perspective, but there is ample reason to admit complex rights into our moral ontology and doing so can help bridge the divide between global health practices and ongoing work in the philosophy of rights and public policy. Recognition of complex rights admittedly shifts the burden for justifying health rights, but it does so in a way that is instructive for general philosophical analysis of socio-economic rights. La presente contribución tiene por objeto examinar el problema de la relación entre las esencias y Dios en la metafísica de Leibniz, fundamentalmente a la luz de la oposición y evolución de dos modelos que dan cuenta de una transición significativa en su metafísica de las esencias, a saber, un modelo teo-mereológico según el cual las esencias constituyen la naturaleza ontológica de Dios y, en el límite, se identifican a él (1668 – 1676) y un modelo representacional que hace de (...) las esencias objetos intencionales del entendimiento de Dios, sin que ellas constituyan propiamente, ni puedan identificarse a Dios ni a su entendimiento (1680 en adelante). Por medio de un análisis de diversos manuscritos de Leibniz, así como una remisión a algunos estudios relativos a la ontología leibniziana de las esencias, nuestro propósito consiste, particularmente, en mostrar de qué manera y por qué el modelo teo-mereológico adoptado por el joven Leibniz es superado por un modelo representacional. This article aims to offer a fresh analysis of two passages in the extensive necromancy episode in Lucan's Bellum Ciuile: the ritual to reanimate the dead soldier's corpse (6.667–73), and the surgical procedure Erichtho then proceeds to undertake (6.750–7), resembling the practice of a vivisection. The study will focus mostly on the strong connection of magic to medical traditions in antiquity, with a commentary on, and analysis of, these verses through the lenses of medical vocabulary, themes and motifs. It ultimately (...) concludes that Lucan was familiar with the language and characteristics of the medical tradition, enriched his report with them, and was playing with his audience's knowledge of the same. O que é a catástrofe? O que a leva, a cada reedição, manter a sua essência última? De que forma, de tempos em tempos, ela se reinventa a ponto de impor uma agenda da qual o filósofo não pode deixar de pautar como um ponto interrogativo acerca do seu real sentido e alcance? Essas entre outras questões se colocam na emergência aqui do debate que procuraremos balizar à luz da obra fenomenológico-existencial de Gabriel Marcel. Trata-se de revisitar, a partir, sobretudo, (...) de Les Hommes Contre l’Humaine, um de seus escritos mais marcantes quanto ao tema, a maneira própria como o filósofo faz um balanço da tragédia de nossa época. Se advoga então a tese de que o fenômeno catastrófico se liga essencialmente a uma atitude sintomática de nossa cultura metafísica que tomou asas no Ocidente: o espírito de abstração. Como contraofensiva a essa escalada espiritual, o texto termina por conclamar uma tomada de consciência mais exigente: a reconquista do concreto. (shrink)

Em uma sociedade a instauração de conflitos de pretensões não é aprazível para os cidadãos, sendo necessário o uso de formas e instrumentos para que ele seja eliminado. Diante deste panorama conflituoso surge o Direito como mediador social, pois funciona como uma ferramenta de participação que tem a habilidade de promover a realização da cidadania, buscando instalar e restituir pactos sociais, tornando os sujeitos conscientes de seus direitos e deveres e mais solidários perante as desordens sociais experimentados por distintos sujeitos. (...) Para Habermas (1997), o direito está situado em um conflito entre facticidade e validade, entre o que se encontra no nível factual e o no normativo. “O que é válido precisa estar em condições de comprovar-se contra as objeções apresentadas factualmente” (Habermas, 1997, p. 56). É uma relação conflituosa posicionada internamente e externamente ao próprio direito. O interesse de Habermas está ancorado no ponto de vista metódico, com o qual a sociologia do direito não pode prescindir de uma reconstrução das condições de validade do acordo de legalidade, pressuposto nos modernos sistemas de direito. Para Habermas, a positivação do direito moderno e a diferenciação entre direito e moral não faz desaparecer a pretensão de legitimação do direito, ao passo que mesmo a positividade jurídica pós-metafísica necessita de princípios justificados racionalmente e, dessa maneira, universais. Na teoria social de Max Weber verificou a concretização do direito como um modo de moralização do ordenamento jurídico, com a caracterização da estrutura formal do direito e a sua indispensabilidade. Esse procedimento é chamado de juridificação, pois conjectura o aumento da normatização jurídica sobre a vida social. Em Kant, sua forma do “imperativo categórico” é instrumentada com características discursivas e consistirão no representante para do processo legislativo, que opera de modo normativo ao respaldar as leis jurídicas que tem a possibilidade de se tornarem uma aceitação universal e atua de forma disciplinadora às normas que se encontrem em conflito com os princípios do direito.
